DV Bill - A Laxman Rekha for Surpanakhas too
While the government is pretending sleep on the misuse of 498a, it is turning on a deaf year to the pleads of the future of the country the earning male (because legally the women is dependent) further after the share in the parental property the girl gets a few more rights that makes her a super power gender in reality and still is legally an abla.
I personally would welcome any such bill as a good idea but I would be against such a bill if it is poorly drafted and that it would encourage and attract only the mis-users at large. Why are these politicians over looking at the record low conviction rate in the non-compoundable offence of 498a.
23 years later this bill comes in as a shock adding insult to the injury as not even a single comma has changed in the 498a definition and they come up with another paralyzing shot in the system. Well, times have changed, so have the attitudes of the women, the newspapers in 1983 used to talk about etiquettes of dining table arrangements to the shape of a decent neck cut on a blouse that is not deep, till recently I read shocking articles in women sections about the etiquettes of one night stands. Holy shit. And you come up with something like Domestic violence bill that comes with contradictions of allowing a woman to work ( I am not against it but let us balance it) and also asking separate shelter and many other loop holes to the earning lady with an independent attitude who is still an abla.
The media has been very suspicious and un-gungho about this at large. I saw the first reactions on ZEE News (hindi and Gujarati) expressing the launch of a bill with a fear and sarcasm showing concern of the harassed and terrorized husbands and his family members, it also notices that an earning women can demand money but husband asking questions on her income leads to variety of abuses. So did Karan Thapar some one year ago expressed his grave concerns of the misuse of the poor draft of this bill, on CNBC with unconvincing and speechless Indira Jaising to his questions. TOI has also recorded the fact that the bill is apprehended as manipulative.
My immediate fears of the Loop Holes:
Financial Abuse: Well Karan Thapar did point out the loophole that if the husband falls short of Rs.200 of the Rs.1000 demand of the wife then that becomes a financial abuse.
Separate House: My observation with manipulative women would come up with conditions where they report their husbands and the relatives as abusers from day 1 till the D-Day. And would create a strong ground to secure themselves with a house. Further they would also provoke the family into a situation that would lead in to such circumstances. It is always the girl who wants the parents out of the house and this spells a huge disaster on the system of joint family and elder protection. Freezing of assets by girl is another catastrophe for a hard working middleclass boy’s family who has DIL in the family from a poor house in a principled dowry less marriage.
Laxman Rekha for Surpanakha: My biggest fear is the separate house and rent allowances to the actual independent women who’s hidden agenda is to stay separately and live a life without loyalty attached. The so called abusive husband or his relatives cannot approach her at the workplace in the name of security or the area confined to her will be free from check and access of the alleged abusive partner thus allowing gross adultery by the paper abla wife. Because if anyone is questioning her then that would also amount to Verbal Abuse.
Verbal Abuse: What decides this? Well a girl would decide what abuse is and what is not. And then the rest would be the head ache and work of the investigating officer would be deputed to find out in this corrupted frame work.
Emotional Abuse/ Sexual Abuse/ Forced Pornography: Oh my God. Someone shrug these people. What is the method to measure the Emotional Abuse? And what is the guarantee that these women would not lie? What is the back up? Next, is forced intercourse, well, this is because impotency cases are not in high conviction against the lie of impotency spilled out by the lying women? How do you prove force? Pornography: There are so many women who are getting in to group sex and swapping and sex and cam chat. There are many women who force sex on husbands and on refusing attack them. They are so many women who exchange porn CD’s in the Mumbai trains etc. Now as per DV that is not offence?
For the Live In Ladies: Swarup had pointed out very early about the legal first wife likely to be cheated and Vinayak explains that the second lady would highjack the mall and sue the owner for defective goods. Plus this blog in too has been shouting on the misuse of DV Bill.
Heads She Wins, Tails He Loses: So the shots will be now called by the lady as to what to interpret and when an interest may become abuse at any given time; extra work/ head ache and income for the officers and over all loser is the male squad (aka criminal-so called by default) at any given point of time. So he just has to be henpecked or handcuffed.
The bill has a lot of scope to become full proof. I would give half star on a rate of 5 (being the highest) the half point is for child sexual abuse but what about the lady teachers who forces sex upon them? Well NO! this bill ostensibly is for the ladies, of the ladies. I take the half star back and disqualify this whole bill. But how can I exercise my democratic right? This is India. Here terrorists rule with the help of politicians who plead mercy for them. And more over I am an Indian male and an Indian Husband.
Domestic Violence Bill: DV is nothing else but a Deadly Venom that will kill the institution of marriage, a Dormant Volcano in waiting in each house that has a remote in the hands and mercy of the attitude of the lady.
Where the mind is with fear and head is held in shame. In that hell of slavery let the country perish. The worst is yet to come.
Cheated, falsely blamed and tortured by my own country,
